These Terms govern the Qwells website and PathoCare LMS subscription service. By creating an account, paying an invoice or using the service, the subscribing laboratory or business ("Customer") agrees to them.
1. Service
PathoCare LMS supports laboratory administration, patient registration, billing, test setup, result entry, report generation, sample tracking, backups and related operational features. Customers must provide accurate account and billing information.
2. Medical responsibility
PathoCare LMS is an administrative and reporting tool, not medical advice or diagnosis. The Customer is solely responsible for test methods, reference ranges, results, quality controls, report authorisation, clinical interpretation, patient consent, laboratory licences and legal compliance. An authorised laboratory professional must verify all data and reports before use.
3. Accounts and acceptable use
The Customer is responsible for its users and credentials. Users must not access another customer's data, upload malicious material, probe security, bypass limits, reverse engineer the service, resell access without written permission or use the service unlawfully.
4. Subscription, payment and taxes
The selected plan, billing period, price and applicable taxes are shown before payment or on an accepted quotation. Fees are paid in advance. A subscription renews for the selected period until cancelled. Future price changes will be communicated before renewal and will not change an already-paid period.
5. Customer data
The Customer retains its rights in data it enters and permits Qwells to host, process, back up and transmit that data only to operate, secure and support the service. The Customer confirms it has lawful authority to provide all data and instructions. Qwells retains rights in the software, design, documentation and brand.
6. Availability and support
We aim for reliable service but cannot promise uninterrupted or error-free access. Planned maintenance, emergency maintenance, internet failures and third-party outages may affect availability. Support response times are targets unless a separate written service level is agreed.
7. Cancellation and termination
The Customer may stop renewal under the Refund & Cancellation Policy. Qwells may suspend or terminate access for material breach, unlawful use, security risk or non-payment, normally after notice where practical. Customers should export required records before account closure.
8. Warranty and liability
To the extent permitted by law, the service is provided on an "as available" basis. Qwells is not responsible for medical decisions, incorrect customer configuration, unauthorised credentials, indirect loss, lost profit or events beyond reasonable control. Qwells' total service liability will not exceed fees paid for the affected service during the three months before the event, except where law prohibits that limit.
9. Governing law
These Terms are governed by Indian law. Both parties will first try to resolve disputes in good faith through written notice. Subject to applicable consumer law, courts in Purnea, Bihar will have jurisdiction.
10. Changes
Terms may be updated for legal, security or product reasons. Material changes apply prospectively and will be posted with a revised date.
